The proposal which sought retrospective consent for the property on Cressex Road was granted conditional permission by Buckinghamshire Council.

In a statement it explained: “The existing site has been running as a restaurant since 2012; our client took over an existing running business which had the extraction and kitchen already setup.

“Since 2012 to date the premises has been running successfully and there has been never been any complaints or issues in terms of odour or noise.

“The premises will continue to operate as a restaurant; the application has been made for the retention of the existing canopy with additions to the system as recommended by the noise consultant.

“Another new extract canopy has also been proposed for the same restaurant to cater for the growing customers and ensure orders are prepared on time.”

In response to the plans an environmental health officer commented said: “This premises has been subject to a number of noise nuisance complaints in regard to the odour and noise from the existing extraction.

“The latest such complaint leading to this retrospective planning application for regularisation of use of the existing system (subject to recommended changes) and an additional extraction system further along the flat roof.”

A bid to create a new access on to an existing drive in Marlow have been approved.

The application sought a certificate of lawfulness for the proposed creation of a new vehicular access into the existing drive, at the house on Barnhill Road, which Bucks Council granted.

As the application is a certificate of lawfulness it seeks confirmation that the development would be lawful to implement as permitted development.

This type of application is a legal exercise. If the development meets the criteria in the legislation then it constitutes permitted development and does not require express planning permission.

Normal planning considerations cannot be taken into account for this type of application.
