A Beaconsfield homeowner has been ordered to tear down a ‘danger’ gate that was installed without permission.

The house on Hedgerley Lane has been served with an enforcement notice by Buckinghamshire Council for the unauthorised erection of the gate.

The owners have been told they must comply with the councils wishes or risk prosecution and, or remedial action by the council.

In the notice, the authority said the work creates a “danger” and “inconvenience” for drivers and pedestrians.

It added: “The gate is located at an inadequate distance back from the junction with Cross Lane and Hedgerley Lane, resulting in vehicles having to remain stationary on the carriageway while waiting for the gate to open.

“This obstructs the free flow of traffic and leads to danger and inconvenience for both highway users and pedestrians, particularly given the site’s proximity to a priority junction and nearby community facilities.

“The development is therefore considered to have an unacceptable impact on highway safety and is contrary to … the national planning policy framework.

“The Council does not consider that planning permission should be given, because conditions could not overcome these objections to the development.”

The homeowner has been ordered to remove the gate, as well as clear all materials and debris resulting from complying with step one of the notices from the land.

If the order is not complied with, the homeowner could face fines or even prosecution unless they can successfully appeal the decision to the Secretary of State.

The notice was issued on September 16  and takes effect on November first giving the homeowner two months to comply with it.

The council added: “The Enforcement Notice seeks a complete remedy to the breach and its purpose, therefore, falls within Section 173(4)(a) of the Town and Country Planning Act 1990.

“The steps required by this Notice do no more than achieve a complete remedy of the breach by discontinuing any use of the land or by restoring the land to its condition before the breach took place.”
